Please read this information carefully. The Settlement Class consists of all self-funded
employer plans, private insurance providers, managed care organizations, insurance
companies, employee benefit plans, health and welfare funds, union plans, workers’
compensation entities, HMOs, PPOs, and other private entities in the United States
and its territories – that purchased, reimbursed and/or paid for OxyContin prescribed
to their beneficiaries, members, employees, or insureds from December 12, 1995 to
December 12, 2008.

Final Approval Hearing
On May 15, 2009 the Honorable Judge John G. Koeltl of the United States District
Court for the Southern District of New York granted final approval of the $20 million
dollar settlement.
The Lawsuit and Terms of the Settlement
The lawsuit claims, among other things, that the Defendants encouraged physicians
to prescribe OxyContin for medical indications other than those that were approved
by the FDA, and without adequately describing the addictive qualities of the drug.
The lawsuit also claims that the Defendants’ conduct caused physicians to prescribe
the drug, and caused TPPs to pay for the drug, under circumstances and for purposes
for which it was not indicated. The Defendants deny all of these claims and any
liability and have entered into the Proposed Settlement solely to avoid the further
expense, inconvenience, burden, and uncertainty of this lawsuit. The Defendants
have agreed to pay $20 million to settle the claims set forth in Plaintiffs’ lawsuit,
plus the costs of notice and administration of the Proposed Settlement up to $1
million.
Your Legal Rights and Options in this Settlement
If you are a Class member, you have the following options:
- Submit a Claim Form: The official court-ordered deadline for filing a claim has
passed. Claims needed to be postmarked by May 18, 2009.
- Exclude Yourself: The Exclusion Deadline has passed. Exclusions had to be postmarked
by March 19, 2009.
- Object: The Objection Deadline has passed. Objections needed to be filed with the
Court and served on Lead Class Counsel and Counsel for Defendant by March 19, 2009.
